Terms of Service

These Terms of Service (“Terms”) govern your use of the ProvenPath™ Career Launcher platform (the “Service”) operated by Winder CNA Training (“we,” “us,” or “our”). By creating an account or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy.

1. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement to use the Service. You agree to provide truthful, accurate information about yourself, your credentials, and your employment status. Misrepresenting credentials (including licensure) is a material breach of these Terms and may be reported to the relevant state or national licensing authority.

2. Accounts

You are responsible for keeping your account secure. Do not share your login link or session with anyone else. You are responsible for all activity that occurs under your account. Notify us immediately at support@windercna.com if you suspect unauthorized access.

3. What the Service Is

The Service is an online marketplace that connects graduates and prospective hires of healthcare training programs (including Winder CNA Training students and general public members) with healthcare employers. We do not employ you. We do not guarantee employment, interviews, or any specific outcome.

4. Profile Data and Employer Access

When you create an account and enable your profile for discoverability, healthcare employers can view a limited version of your profile (name, program, general location, readiness signals). Contact details (email, phone, license number) remain hidden until an employer takes a specific action to unlock them, at which point those details are shared with that employer for hiring purposes only. Employers who access your unlocked contact information are bound by the Employer Data Use Agreement, which limits what they may do with your data.

You can make your profile private at any time from your profile settings, which will remove it from discovery. Previously-unlocked contact information already shared with an employer cannot be retroactively hidden from that employer, but no new employers will gain access.

5. Paid Services

We currently provide the Service to graduates and public community members at no charge. We may offer paid features (e.g., enhanced AI tools for public members; paid applicant search and contact unlocks for employers) in the future. We will give you reasonable notice before charging for a feature you currently use for free. You are never charged for the basic act of listing your profile or responding to an employer who contacts you.

6. Acceptable Use

You agree not to:

  • Impersonate another person or misrepresent your credentials, licensure, or employment eligibility.
  • Use the Service to harass, threaten, or defame others.
  • Attempt to access data or accounts not belonging to you, probe for vulnerabilities, or interfere with the Service’s operation.
  • Scrape, resell, or redistribute data from the Service, including student profiles or job listings.
  • Use the Service for any unlawful purpose or in violation of applicable employment, anti-discrimination, or healthcare credentialing laws.

7. Communications

By creating an account you consent to receive transactional email from us (sign-in links, application notifications, account alerts, service updates). Promotional or marketing email is separate and only sent if you opt in. You can opt out of marketing email at any time via the unsubscribe link in any marketing message or in your account settings. Transactional email continues regardless of marketing preference.

8. Content Ownership

You retain ownership of the content you submit (resume text, profile information, etc.). By submitting content you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and share that content with employers as described in these Terms and the Privacy Policy. We do not sell your content to third parties for advertising.

9. AI-Assisted Features

Some features use large language models (currently Anthropic Claude) to help draft resumes, practice interview questions, and generate readiness-test feedback. AI outputs are suggestions and may contain inaccuracies. You are responsible for reviewing and verifying anything you send to an employer. We may use anonymized, aggregated inputs to improve the Service; we do not send your personal identifiers to the AI provider beyond what is minimally necessary to produce a response.

10. Termination

You can delete your account at any time from account settings or by emailing support@windercna.com. We may suspend or terminate accounts that violate these Terms, with or without notice. On termination, we will delete your account data per the retention policy described in the Privacy Policy, except as required for legal compliance.

11. Disclaimers

The Service is provided “as is” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure from unauthorized access. Employer listings and applicant profiles are submitted by the respective users and are not verified for accuracy unless explicitly stated (e.g., Winder CNA Training graduate certification).

12. Limitation of Liability

To the fullest extent permitted by law, our aggregate liability for any claim arising from your use of the Service will not exceed the amount you paid us in the twelve months preceding the claim, or $100, whichever is greater. We are not liable for indirect, incidental, consequential, or punitive damages, including lost employment opportunities or lost wages.

13. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your violation of these Terms, your misrepresentation of your credentials or employment eligibility, or your use of the Service in a way that injures another user or a third party.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced via email or in-product notice at least 14 days before taking effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. The version and effective date are listed at the top of this page.

15. Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of laws principles. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Barrow County, Georgia, and you consent to the jurisdiction of those courts.
